Rental Terms & Conditions 

1. Agreement Term & Occupancy Rights

This agreement is for a fixed term only and automatically expires at the scheduled checkout date and standard checkout time specified in the guest’s reservation confirmation. Guest has no right to remain beyond this date and time.

Holdover Occupancy

Any holdover is strictly unlawful. Holdover damages shall equal the greater of:

• Two times the highest published nightly rental rate during the holdover period, or

• $500 per day

This does not create any tenancy, tenancy at will, or tenancy by sufferance. Guest is considered an unlawful occupant subject to immediate eviction.

Expedited Eviction

Where permitted by law, Owner may seek immediate possession through expedited eviction without further notice. Guest expressly waives all statutory notice rights to the fullest extent allowed.

2. Parties to the Agreement

This Terms and Conditions document is made effective on the booking confirmation date between Luxury Lodging Host LLC, associated property owners ("Owner"/"Manager"), and the Guest. It applies to all individuals in the Guest’s party. Guest is responsible for sharing these Terms with all members of their group.

3. Identification, Verification & Check-In Requirements

Guest must provide a government‑issued photo ID and the credit card used for booking at check‑in. Copies may be retained for verification and security.

4. Prohibited Activities & Immediate Eviction

The following activities are strictly prohibited and result in immediate eviction without refund:

• Illegal activity of any kind, including drug use, prostitution, human trafficking, or other unlawful conduct

• Tampering with security cameras, smart home devices, or noise monitoring sensors

Owner may report violations to law enforcement.

5. Property Use & Guest Responsibilities

Guests must:

• Follow all posted rules and regulations on the premises.

• Keep the property clean and safe.

• Avoid creating unsafe or unsanitary conditions.

• Not engage in commercial or illegal activity.

A breach of any guest duty constitutes a material violation and may result in eviction without refund.

Occupancy Limits

Guest count must not exceed the maximum occupancy listed in the property description. No fraternities, school groups, civic groups, or non-family groups are allowed without Owner approval.

Assignment & Subletting

Subletting or assigning the reservation is prohibited.

6. Owner Access to Property

Owner may enter the property:

• For inspection if damage is suspected

• For maintenance or repairs

• For real estate showings if the property is listed for sale (with notice)

Guest must inform Owner if anyone in the party is a registered sex offender; this must be reported to local authorities prior to check-in.

7. High-Risk Amenities, Environmental Hazards & Assumption of Risk

The property may include high-risk amenities such as:

• Pools, hot tubs, docks, and natural water features

• Firepits

• Kayaks, paddleboards, and other watercraft

• Wildlife exposure (e.g., alligators, snakes, hazardous animals)

Use of any amenity is voluntary and at the Guest’s own risk.

Hazardous Amenity Rules

• No unsupervised children near pools, hot tubs, docks, or water.

• Alcohol or drug use near these amenities is dangerous and strongly discouraged.

• Diving is prohibited.

• Life jackets are required when using watercraft.

• No person or pet should enter natural water under any circumstance.

Wildlife Awareness

Proximity to natural water increases the likelihood of wildlife encounters. Guests may not approach, feed, or provoke wildlife.

8. Liability Waivers & Indemnification

Release of Liability

Guest releases and holds harmless Luxury Lodging, its owners, agents, employees, affiliates, and insurers from all liability related to:

• Injury, illness, or death

• Wildlife encounters

• Recreation accidents (drowning, slips, falls, burns, collisions)

• Weather events

• Equipment failure or misuse

This applies even if caused by Luxury Lodging’s negligence.

Guest Indemnification

Guest agrees to indemnify and defend Luxury Lodging against any claims arising from:

• Guest use of the property or amenities

• Injury or damage to third parties

• Failure to supervise minors or invitees

• Violation of laws or this agreement

• Guest negligence or misconduct

9. Emergency Response

Luxury Lodging is not responsible for emergency medical care. Guest must contact emergency services independently in case of incident.

10. Damage Reporting & Property Condition

Guests must report damage or maintenance issues immediately. Failure to report may result in security deposit deductions.

Post-departure, unreported damage is assumed to have occurred during the stay.

Owner is not responsible for items left behind. Lost and Found items may be shipped at Guest’s expense; unclaimed items after 30 days will be discarded.

11. Appliance, Equipment & Utility Failures

No refunds are provided for:

• Inoperable appliances, pools, hot tubs, elevators

• Power outages

• Water shortages

• Weather conditions

• Construction nearby

Owner will make reasonable efforts to repair issues.

12. Noise, Security Cameras & Monitoring

Guests must comply with local noise laws. Excessive noise may result in eviction.

Security cameras may be installed externally. Tampering is prohibited and grounds for termination without refund.

Noise monitoring devices may be present.

13. Trash Disposal

Guests must dispose of trash per property instructions. Improper trash disposal may result in loss of security deposit.

14. Pets & Children

Pets

Pets require advance Owner approval. Unauthorized pets result in immediate eviction and forfeiture of all payments.

Children

Guests must disclose the number of children (under 18) staying at the property.

15. Property Description & Subjective Claims

Listing Accuracy

Guest acknowledges reviewing and accepting the listing details. No refunds are issued for dissatisfaction with accurately described features.

Subjective Claims

Complaints regarding subjective preferences (cleanliness perception, decor, noise, etc.) do not qualify for refunds.

16. Plumbing Use & Blockages

Plumbing fixtures may only be used for their intended purpose. Guest is responsible for costs resulting from blockages or misuse.

17. Force Majeure

No refunds are provided if the property becomes unavailable due to:

• Natural disasters

• Government restrictions

• Events beyond Owner control

Guests are strongly encouraged to obtain travel insurance.

18. Governing Law, Jurisdiction & Legal Fees

This agreement is governed by the laws of the property's jurisdiction. Venue lies in the local courts.

If Guest initiates legal action and does not prevail, Guest must pay Owner’s legal fees, arbitration costs, and associated expenses.

19. Arbitration & Dispute Resolution

Disputes shall be resolved by binding arbitration administered by the American Arbitration Association.

Guest waives:

• The right to jury trial

• The right to participate in class actions

Owner’s liability shall not exceed the total paid by Guest.

20. Authorization to Charge & Billable Damages

Guest authorizes Owner to charge the payment method on file for:

• Damage

• Excessive cleaning

• Missing items

• House Rule violations

Definition of Billable Damages

Includes but is not limited to:

• Destroyed/stained linens

• Damage to structure or furnishings

• Missing inventory

• Cleaning for smoking, pets, bodily fluids, or negligence

Sole Discretion of Determination

Owner determines what constitutes damage or excessive wear at its sole discretion. Guest waives the right to dispute this determination.

Waiver of Chargeback Rights

Guest may not initiate chargebacks regarding damage charges. Attempts will be treated as breach of contract, and recovery fees of at least 100% of the chargeback amount may apply.

Timing of Charges

Charges may be applied up to 90 days after checkout.

21. Payment Terms

• Payment is taken at booking.

• Remaining balance is due 60 days before arrival.

• Automatic credit card charge will be attempted; failure to pay results in cancellation without refund.

• Refunds (if applicable) are processed by card or check.

22. Security Deposit 

A security deposit from $500 up to $2,000 is required and may be held within 60 days of arrival.

If property is returned undamaged beyond normal wear, the deposit is released within 15 days.

Owner may deduct costs for:

• Cleaning

• Hot tub draining/refilling

• Trash removal

• Missing items

• Damage repair

• Service calls

If damages exceed the deposit, Guest authorizes charges to their payment method or agrees to pay via check within 10 business days.

23. Cancellation Policy 

• No refunds after reservation is confirmed.

• Travel insurance, damage protection, administrative/processing fees, and extra services (pool heat, early check-in, etc.) are non-refundable.

By booking, the Guest acknowledges, accepts, and agrees to be legally bound by all Terms & Conditions contained in this Agreement.
